Conveyancing is defined as: The action of preparing documents for the conveyance of property. The branch of law concerned with the preparation of documents for the conveyance of property.

A conveyancer will complete the process for you from beginning to end, and ensure you are complying with the law along the way. While the general process may be the same, the procedures will be different in every file.

The Vendor Statement (Section 32) is a mandatory document that discloses information that may affect the value of the land being sold in a property transaction and a prospective Purchaser’s decision to purchase the property.. The term ‘Section 32’ is derived from the correlating section under the Sale of Land Act 1962 (VIC).

Both the Victorian State Government Department of Environment, Land, Water and Planning and the State Revenue Office have useful Calculators on their websites (links below) to assist in calculating your Government Land Transfer (Stamp Duty) and Registration Fees.

It is now mandatory in Victoria to carry out settlements in the electronic lodgement network. The most common platform used is called PEXA.

PEXA (Property Exchange Australia) is Australia’s online property exchange network. It assists members – such as lawyers, conveyancers and financial institutions – to lodge documents with Land Registries and complete financial settlements electronically.

Verification of Identity (VOI) is a requirement from the Titles Office for every person that transacts Real Estate in Victoria. It reduces the risks of identity fraud and unauthorised property transactions, and helps to ensure that the correct person is dealing with land. VOI’s are required to be completed before a Vendor Statement is signed for a sale, or before settlement for a purchase. We will send you the paperwork you need to complete the VOI when we open your file.

You will need either:

• A current Passport (less than two years expired) and current Drivers licence/Proof of age card; OR
• A, full birth certificate/citizenship certificate, current Drivers licence/Proof of age card and a Medicare card
• If you have changed your name since birth, you will also require a Marriage Certificate or Change of Name Certificate from Births Deaths and Marriages
